Fortunately or unfortunately, depending upon you ask, Carrie Prejean will never give up, and that's to her credit. I say this despite being an unabashed fan of film (and tape) nudity. If Vivid acquired the tapes through less than ethical means, Carrie should continue the fight. I wouldn't mind seeing the tapes, but not this way,

The tapes were given to Vivid by her ex-boyfriend, who was given them by Carrie herself. They no longer belonged to her and thus were no longer her personal property. He gave them to Vivid willingly (and probly for a bit of cash) so she honestly has no grounds to stand on. These videos were not stolen from her home, or taken without her consent. She will lose.

Sorry Bob, but ownership of a physical copy and ownership of copyright are two separate things. Assuming Carrie Prejean made the recording herself, she is the sole "author" for copyright purposes. Transferring ownership of one copy, even if it's the original, doesn't transfer ownership of copyright.

Without any evidence that Carrie intended to transfer copyright (fat chance), I really don't see how Vivid can claim distribution rights.
